Short-term rental in Turkey is legal only with a Ministry of Tourism permit: Law 7464, how to apply, 2026 fees, fines and tips for buyers.

Short-Term Rental in Turkey: Law 7464, Permit, Fines (2026)

Short-term rental in Turkey, meaning renting out a home for 100 days or less (such as daily rentals on Airbnb), has been legal only with a "tourism rental permit" from the Ministry of Culture and Tourism since January 1, 2024. To obtain this permit in an apartment building, the consent of all owners in that building is required, the permit and plaque fee in 2026 is TL 20,000 per unit, and renting without a permit carries a fine of at least TL 180,617 in 2026. In this guide we have gathered in one place the content of the law, the steps to get the permit, the full table of fines and what you need to know before buying an apartment for daily rental.

What Does the Short-Term Rental Law in Turkey Say?

Law No. 7464, titled the "Law on the Rental of Residences for Tourism Purposes and Amendments to Certain Laws" (Konutların Turizm Amaçlı Kiralanmasına ve Bazı Kanunlarda Değişiklik Yapılmasına Dair Kanun), was published in Turkey's Official Gazette on November 2, 2023, and its main provisions took effect on January 1, 2024. Its implementing regulation was published in the Official Gazette on December 28, 2023.

The law's key definition is this: renting out a home for any purpose for a maximum of 100 days counts as "rental for tourism purposes". It makes no difference whether the guest is a tourist, a student or someone who has come for work. A rental of more than 100 days at a time is an ordinary residential lease and is not subject to this law.

A summary of the law's main rules:

  • Permit before the contract: every home rented out short term must hold a "tourism rental permit" (izin belgesi) before the rental contract is signed.
  • Plaque at the entrance: a plaque specified by the ministry must be installed at the unit's entrance.
  • Consent of all owners: in a multi-unit building, a unanimous decision (oy birliği) of all owners of that building is required.
  • 25% cap: in buildings with more than three units, one person can obtain permits for at most 25% of the units in that building. If someone wants permits for more than five units in one building, a business license is also required.
  • No subletting: a tenant cannot rent out, on their own account, a home they rented for residence on a daily basis.
  • Guest identity registration: the Identity Notification Law (Kimlik Bildirme Kanunu) applies to these homes, and the permit holder is responsible for registering guests' details in the KBS system.

An important exception: under Article 3 of the law, "quality residences" (rezidans) whose management plan approves this use are exempt from the owner-consent requirement and the 25% cap, and their files are reviewed directly by the ministry. The Sakarya provincial culture and tourism directorate has also stated that detached homes (müstakil) such as villas are exempt from the consent form, business license and 25% cap.

Who Can Apply and What Documents Are Needed?

The property owner, or someone with a usufruct right (intifa hakkı) or a surface right (üst hakkı), can apply. Foreigners who hold the title deed in their own name follow the same route. The main documents, according to the ministry's official notice:

  • Title deed (tapu)
  • The building owners' consent form (muvafakatname), in the ministry's template, for multi-unit buildings
  • In multi-block complexes, the unanimous decision of all owners
  • A business license, if you have more than five units in one building
  • If the property type on the deed is "land" or "garden", an occupancy permit (Yapı Kullanma İzin Belgesi) or a building registration certificate

You also need a tax number for administrative and tax matters; if you do not have one yet, see the guide to getting a tax number in Turkey.

Steps to Get a Short-Term Rental Permit (Step-by-Step Checklist)

According to the notice from the General Directorate of Culture and Tourism, all applications are made only through e-Devlet, and in-person applications are not accepted:

  1. Get the owners' consent: before anything else, collect the written consent of all building owners in the ministry's template. Without it the file is rejected.
  2. Submit the application on e-Devlet: open the "Turizm Amaçlı Konut İzin Belgesi Başvurusu" service and upload the documents as PDFs. The application itself is free.
  3. Fix deficiencies: if a document is incomplete, you have 5 days to complete it.
  4. Review: the legal period for review and announcing the result is 60 days.
  5. Pay the fee: after approval, you pay the 2026 fee (TL 10,000 for the permit and TL 10,000 for the plaque) and upload the receipt on e-Devlet within 15 days.
  6. Permit issued and plaque installed: the permit is issued, the plaque is ordered from the ministry and must be installed on the entrance door.
  7. Inspection: the home is placed in the inspection program, and within 30 days after the permit is issued, its conditions are compared against Chapter 3 of the regulation. If there is a deficiency, you are fined and have 15 days to correct it; otherwise the permit is canceled.
  8. Register on the platforms: enter the permit number in your listing (details in the Airbnb section below).

Fines for Short-Term Rental Without a Permit (2026)

The base amounts are set out in Article 4 of Law No. 7464. Turkish administrative fines in lira are updated every year by the "revaluation rate" (yeniden değerleme oranı). The Culture and Tourism directorate has officially announced the 2026 amount of the TL 100,000 base fine as TL 180,617; the last column of the table is calculated for the other items using the same multiplier (the 2025 rate of 43.93% and the 2026 rate of 25.49%) and is approximate.

Violation (Article 4 clause)Base amount in the law2026 amount
Renting without a permit, per unit (1-a)TL 100,000TL 180,617
Continuing without a permit after the 15-day grace period (1-b)TL 500,000About TL 903,000
Continuing after both fines above (1-f)TL 1,000,000About TL 1.8 million
Subletting by a tenant, per contract (1-c and 1-ç)TL 100,000TL 180,617
Brokering a home without a permit, per contract (1-d)TL 100,000TL 180,617
More than four contracts over 100 days for one unit in a year (1-g)TL 1,000,000About TL 1.8 million
Not installing the plaque (2-f)TL 100,000TL 180,617

Not providing requested information within 30 days (2-a)TL 50,000About TL 90,000

Two points that are talked about less often:

  • The law anticipates workarounds: someone who tries to avoid the permit by renting a unit out on back-to-back "101-day" contracts faces a fine of TL 1,000,000 (the base amount) if they do this more than four times within a year.
  • Platforms are liable too: if a platform does not remove a listing for an unpermitted home within 24 hours of the ministry's notice, it is fined for each unit.

Airbnb and Booking: What Changed From April 2026?

According to Airbnb's official guide for hosts in Turkey, from April 1, 2026, a host must enter three things for each listing: the permit number, the name of the permit holder exactly as it appears on the ministry document, and the property address. This information is matched against government records, and listings with invalid information cannot continue. Airbnb has also announced that short-term rental of a single room is no longer possible, and only a whole permitted unit can be rented daily.

Short-Term or Long-Term Rental: Which Is Better for an Investor?

If day-to-day management is hard for you or the building will not give collective consent, a long-term rental is simpler. Before Buying an Apartment for Daily Rental, Check These

Many buyers look only at "how much per night", whereas the biggest obstacle is the legal situation of the building:

  1. Type of building: is the property a detached villa, a residence with a management plan that allows tourism rental, or an ordinary apartment that needs the consent of all owners?
  2. See the owners' consent before buying: if the seller says "daily rental is allowed", ask for the existing permit or the owners' decision in writing. A permit is issued in the name of its holder, and if the owner changes, the ministry must be notified within 30 days.
  3. The 25% cap: if you plan to buy several units in one building, you can obtain permits for only a quarter of the building's units.
  4. Title deed and occupancy permit: check the property's title deed and the status of its occupancy permit (iskan).
  5. Additional costs: in addition to the TL 20,000 for the permit, consider the building's annual costs, insurance and cleaning. See Annual Running Costs of an Apartment in Istanbul and the DASK Earthquake Insurance Guide, and estimate the purchase costs themselves with the Buying Costs Calculator for Turkey.

Tax on Short-Term Rental Income

Rental income, whether short or long term, is taxable, and foreign owners must also declare it in their annual tax return. According to the Culture and Tourism directorate's notice, a home with an active permit is also subject to "accommodation tax" (konaklama vergisi) by the tax office. The VAT and accommodation tax rates for this type of rental have changed several times in recent years, so before you start, consult a licensed accountant (mali müşavir) or ALO TURKEY's advisors. The rules in this area have been amended several times since 2024 (including a regulation amendment in July 2024 for timeshare units) and may change again. This article is general information and does not replace legal advice for your specific property.

Frequently Asked Questions

Is short-term rental in Turkey legal for foreigners?

Yes, provided you hold a permit from the Ministry of Culture and Tourism. A foreign owner with the title deed in their own name can apply through e-Devlet just like a Turkish owner.

How much does a short-term rental permit cost in 2026?

The application is free, and after approval, TL 10,000 for the permit fee and TL 10,000 for the plaque fee, a total of TL 20,000, is paid per unit.

If I rent the home out for 101 days, do I need a permit?

A rental of more than 100 days at a time is an ordinary lease. But if one unit is rented out more than four times in a year on contracts of over 100 days, a heavy fine applies.

How long does the permit application review take?

The legal review period is 60 days. You have 5 days to fix deficiencies in documents and 15 days to upload the payment receipt.
